Terms and Conditions

If you place an order with KIDENTIAL, you have agreed to the following conditions.

1. Prices

1.1 Prices All prices are including VAT in euros and excluding shipping costs.
1.2 Offers All offers on the KIDENTIAL website are without obligation, unless explicitly stated otherwise. Offers do not automatically apply to repeat orders. Furthermore, offers cannot be returned. KIDENTIAL is not bound by its offer if there are programming errors in its website.
1.3 Payment With an order you always have to pay in advance by means of the payment options indicated on the payment page.

2. Shipping

2.1 Transmission via TNT KIDENTIAL sends articles via TNT’s package service. If you are not at home, you will find a note in your mailbox indicating that the package has been delivered to the neighbors. The postman offers your package twice. You do not have to put a signature or legitimize it. Are not you both at home? Then you can pick up the package at the nearest post office. The postman leaves a note on which you can see exactly where that is.

2.2 Shipping costs A contribution to the shipping costs is separately stated to you prior to the time of ordering. This contribution may depend on the order size and the country of destination. The contribution to the shipping costs will not be refunded in the event of a return. Keep an eye on the website for actions. We regularly send the items for free. Shipping costs for abroad are on request: please contact us via info@KIDENTIAL.com . The shipping costs do not consist solely of the franking costs. Other costs such as arranging the order and the package itself also fall under this.

In the Netherlands the standard shipping costs are 3.95 euros per package.

3. Orders

3.1 processing of orders at the moment you place your order, your order is received. You will always receive a confirmation of the order by e-mail. Here you will find the total amount of the order including the shipping costs and payment details. This e-mail is only a confirmation of the payment via Ideal or credit card. You do not have to transfer the money anymore. The confirmation email also includes a ‘track and trace’ number, so you can track the shipment of the package yourself. The ordered items remain the property of KIDENTIAL until the payment obligation has been met.

3.2 Order processing Orders are handled in order of arrival. The site is kept up-to-date as well as possible, but it may occasionally occur that an article is already reserved because someone just before you. When this is the case, we always send a message. You are obliged to purchase the purchased products at the time they are made available to you. If you refuse the purchase or are negligent with the provision of information or instructions necessary for the delivery, the products destined for delivery will be stored for your risk and account.

If you have entered a wrong address for the delivery yourself, then the additional shipping costs are for your account.

If you exceed the maximum delivery time of 30 days, you have the right to terminate the agreement free of charge. To do this you must send an e-mail or letter to KIDENTIAL. In that case, any payments will be returned to you within 30 days of the notification.

4. Delivery

4.1 Delivery We strive to process and ship your order as quickly as possible and in any case within 1 working day after receipt of payment. Orders that are placed before 2.30 pm will normally be shipped the same day if they are in stock. We are not liable for pieces and / or parcels lost at TNT. However, if something goes wrong or the delivery takes a long time, please contact us.

4.2 Complete order If your order includes several items and these are not all in stock, they will only be sent when the order is complete.

4.3 Transport hazard ‘ s during the transport of the items KIDENTIAL will bear the risk in case of damage, theft or loss of items. This risk will pass to you at the time of delivery of the articles. You are then responsible for what happens to the articles.

5. Data

5.1 Privacy KIDENTIAL guarantees that all your data will be handled with the utmost care and that this data will not be passed on, resold or otherwise made available to third parties without your permission.

5.2 internal use KIDENTIAL will process your data and include it in its database in order to fulfill its obligations arising from the agreement that it has concluded with you and / or to process your application. In addition, your e-mail address can be used to inform you about certain products and services that may be attractive to you, unless you have not given permission for this.

6. Exchange and return KIDENTIAL guarantees that the products to be delivered meet the specifications stated on the website.

6.1 Visibility period You are entitled to dissolve the agreement within 7 days of receipt of the relevant product without giving any reason. KIDENTIAL will then return the amount you paid within 30 working days after receipt of the returned product, provided that the product in question is undamaged, not worn, washed or otherwise clearly used or processed and is provided with the original packaging and tickets.

6.2 Exchange Exchange is a possibility provided that the item of clothing is returned in the original state (i.e. with the cards attached to it and without damage) and unused within 7 days of receipt. The shipping costs for return are for you as a buyer. Do not want to exchange but only return? Then we reimburse the purchase price minus the shipping costs charged.

6.3 Liability
We cannot accept any liability for the consequences of text errors. Colors may sometimes vary slightly depending on the color settings on your computer. Keep this in mind. Do you doubt the color? Then contact us.

6.4 Return conditions
– When returning the items, a completed return form must be enclosed.
– Returns must be sent prepaid, unstamped returns are not accepted.
– The items must be sent unused and in the original packaging with attached tickets.

6.5 Returning by complaint
With the utmost care we treat the clothing and we process the order. However, something can sometimes go wrong:
– The wrong article was accidentally sent
– Your order was damaged during shipping
– An article has a manufacturing defect
Please report any complaint as quickly as possible and in any case within 5 working days. Before you return the article, please contact us, because the complaint must be clearly visible and made known. In the case of obvious complaints, we obviously take care of the shipping costs for both the return shipment and for the replacement item for our account. We will gladly solve it with you.

6.6 Complaint too late
If you submit the complaint to KIDENTIAL only after 5 working days, we are entitled to charge all costs for repair or replacement, including administration, shipping and call-out charges.

6.7 Expired warranty
Your warranty on items will lapse if the defect arises as a result of injudicious or improper use or if changes have been made or attempted to be made without the written permission of KIDENTIAL. The guarantee also expires when you have used the article for purposes for which it is not intended.

6.8 Retention of title KIDENTIAL remains the full owner of the delivered article until the purchase price has been paid in full.
7. Payment

7.1 Select payment method During the conclusion of the agreement you determine yourself how the payment will be made. You can pay with iDeal or Credit card.

7.2 Delivery after payment
KIDENTIAL will only proceed to delivery of the product when the payment has been received by it.

7.3 Collection costs
If you fail to meet your payment obligations, KIDENTIAL can not only claim the statutory interest on the amount owed, but also all reasonable costs that KIDENTIAL must incur in order to obtain its claim out of court. The collection costs are set at at least 15% of the principal sum; if KIDENTIAL can prove that it has had to incur higher costs, these will also qualify for reimbursement.

8. Intellectual property rights

8.1 Intellectual property rights
The (intellectual property) rights relating to the KIDENTIAL website, including the rights to texts, images, design, data files, photographs and other visual material, formats, software and other materials, belong to KIDENTIAL.

9. Liability

9.1 Liability
If products delivered by KIDENTIAL are defective, the liability of KIDENTIAL towards you is limited to what is regulated in these General Terms and Conditions under Article 6.

9.2 Limitation
The liability of KIDENTIAL for direct or indirect damage is in any case always limited to an amount equal to the purchase price of the defective product, unless the damage is due to intent and / or gross negligence, or injudicious or improper use by yourself.

9.3 Exclusion
KIDENTIAL excludes any liability for any damage whatsoever, direct and / or indirect, in any way caused by and / or resulting from the impossibility to use the website, the fact that certain information on the website is incorrect, incomplete or not is up-to-date and the unlawful use of KIDENTIAL’s systems, including the website, by a third party.

10. Miscellaneous

10.1 Deviations from the general conditions
Any deviations from these General Terms and Conditions can only be agreed in writing. No rights can be derived from such deviations with respect to later legal relationships.

10.2 Recognition of electronic communication
KIDENTIAL’s administration applies, subject to proof to the contrary, as proof of the requests and / or orders you have made. You acknowledge that electronic communication can serve as proof.

10.3 Annulment
If and insofar as any provision of the General Terms and Conditions is annulled or annulled, the other provisions of these General Terms and Conditions will remain in full force. KIDENTIAL will then adopt a new provision to replace the void / voided provision, whereby the purport of the void / voided provision will be taken into account as far as possible.

11. Applicable law
